Rilis Pers Nomor :352/LBH/RP/XI/2023
Medan 24 November 2023, Penegakan Hukum di Indonesia sedang berduka cita, hal tersebut ditandai dengan konfrensi pers Polda Metro Jaya bersama penyidik gabungan Mabes Polri melalui Kombes Pol. Ade Safri Simanjutkan (Dirkrimsus Polda Metro Jaya) yang secara resmi pada tanggal 22 November 2023 malam telah menetapkan ketua KPK Firli Bahuri sebagai tersangka dugaan tindak pidana pemerasan dan atau penerimaan gratifikasi dan penerima suap terhadap Syarul Yasin Limpo eks Menteri pertanian republik.
Filri diduga melanggar Pasal 12e, 12b atau Pasal 11 UU Nomor 31 Tahun 1999 sebagaimana yang diubah dengan undang-undang Nomor 20 Tahun 2001 tentang pemberantasan tindak pidana korupsi juncto Pasal 65 KUHP dan terancam hukuman penjara seumur hidup.
Tidak hanya itu, berdasarkan catatan ICW Firli pernah beberapa kali dilaporkan ke Dewan Pengawas (Dewas) KPK terkait sejumlah dugaan pelanggaran etik.
Diantaranya kontroversi naik helikopter mewah, pemberhentian 51 pegawai KPK dikarenakn tidak lulus TWK, himne KPK yang berkaitan dengan istrinya, pemberhentian Brigjen Endar, pembocoran dokumen penanganan kasus korupsi di Kementerian ESDM, hingga yang terakhir soal dugaan pemerasan, penerimaan gratifikasi dan suap terhadap mantan Mentan Syahrul Yasin Limpo.
Firli juga tercatat pernah bertemu dengan pihak yang berperkara saat masih menjabat sebagai Deputi penindakan KPK. Eks Kapolda Sumsel itu bertemu dengan mantan Gubernur Nusa Tenggara Barat (NTB) Muhammad Zainul Majdi dan wakil ketua pemeriksaan keuangan saat itu. Atas dua pertemuan tersebut, Tahun 2019 Firli Bahuri dijatuhi sanksi pelanggaran berat oleh internal Komisi Pemberantasan.
Terkait pelanggaran etik naik helikoter mewah Dewas KPK memutuskan Firli melanggar kode etik dan memberikan sanksi ringan dengan memberikan teguran tertulis.
Dimasa kepemimpinan firli juga tercatanya banyaknya permasalahan yang terjadi di internal mundurnya wakil ketua KPK Lilipintauli yang sebelumnya dilaporkan mendapatkan fasilitas mewah menonton MotoGP 2022 pada Grandstand Premium Zona A-Re, korupsi penyidik Robin Pattju dan pungli dirutan KPK.
Atas seluruh permasalahan yang melibatkan Firli, LBH Menilai jika Firli Bahuri merupakan pimpinan terburuk sepanjang sejarah kepemimpinan KPK dan sudah sepatunya dihukum dengan seberat-beratnya.
Sejatinya LBH Mendudga tindak pidana korupsi yang disamatkan kepada firli tidak mungkin dilakukan seorang firli semata. Tindakan firli hari ini juga telah menajdi preseden buruk dalam pemberantasan tindak pidana korupsi di Indonesia.
Buruknya kepemimpinan firli ditandai dengan menurunya Indeks Persepsi Korupsi (IPK) Indonesia yang sebelumnya tahun 2019 diposisi 40 kini menjadi 34.
Bahkan tidak tanggung-tanggung atas banyaknya masalah di KPK, eks penyidik senior kpk Novel Baswedan yang saat ini merupakanWakil Ketua Satuan Tugas Khusus (Satgassus) Pencegahan Korupsi Kepolisian Republik Indonesia (Polri) menyaatakan jika firli penjahat besar.
Tindakan firli diduga telah melanggar UUD 1945 padal 1 angka 3, 28, UU No. 39 Tahun 1999 Tentang Hak Asasi Manusia, DUHAM, ICCPR Jo KUHPidana.
Oleh karena itu LBH Medan mendesak:
1.Presiden Joko Widodo untuk segera menerbitkan Keppers pemberhentian sementara Firli Bahuri karena seyogiyanya penetapan tersangka firli menjadi beban KPK;
2.Polda Metro Jaya segera menahan firli dan memampangkanya kepada publik laksana para koruptor lainya. serta untuk mengungkap kasus ini secara profesional dan objektif karena firli diduga tidak mungkin bermain sendiri dalam tindak pidana korupsi yang disangkan kepadanya;
3.Pemerintah dan DPR untuk merevisi UU KPK dan menguatakan kewenangan Dewas KPK agar tindakan seperti ini tidak terulang kembali.
4.DPR meminta maap kepada masyarakat sebagai tanggung jawab moral karena melolosdkan Firli sebagai pimpinan KPK.
