Medan – Dugaan kriminalisasi terhadap Ilham Mahmudi, warga Desa Kwala Langkat, Kecamatan Tanjung Pura, Langkat kian mencuat. Penjaga hutan lindung dari pengrusakan yang dilakukan mafia ini, dijemput paksa dari rumahnya, Kamis (18/4/2024) kemarin.
Terkait hal itu, Asbabun Nuzul, adik kandung Ilham dan perwakilan warga Kwala Langkat pun meminta pendapingan hukum kepada LBH Medan. Nuzul menerangkan, abangnya dijemput paksa merupakan imbas dari perlawan mereka memerangi mafia yang sedang gencar menguasai hutan Mangrove di sana.
“Abangku dijemput paksa dari rumah tanpa ada menunjukkan surat penangkapan. Abang ku ditarik dan dimasukkan secara paksa ke dalam mobil. Waktu itu ada belasan orang yang mendatangai dan membawa abanglu dari rumah kami,” kata Nuzul, kepada Wadir LBH Medan M Ali Nafiah Matondang di kantornya, Senin (22/4/2024) siang.
Belakangan, Nuzul mengetahui kalau abangya sudah ditahan di Mapolres Langkat atas laporan warga bernama Bahrum Jaya Pelawi. Di mana, Ilham dan warga lainnya dituduh melakukan perusakan sebuah rumah di kawasan hutan lindung.
“Warga merusak rumah itu, karena kesal dengan hutan lindung di desa kami yang sudah porak poranda. Dari pengaduan kami ke Mapolda Sumut, 1 unit ekskavator sudah diamankan dan dititipkan ke Polres Langat,” lanjutnya.
Ironisnya, pelapor terkait perusakan rumah di kawasan hutan lindung yang merupakan antek – antek dari perusak kawasan tersebut, malah dibiarkan ‘melenggang kangkung’. Laporan Bahrum Jaya Pelawi begitu cepat direspon dan Ilham pun ditangkap.
Tak hanya itu, Nuzul dan warga lainnya menegaskan, Sar alias Olo yang memfasilitasi masuknya ekskavator di sana, semestinya juga bertanggungjawab atas kerusakan hutan lindung di desa itu.
Lagi – lagi, laporan Sar alias Olo atas perusakan rumahnya oleh massa di desa itu juga langsung direspon. “Massa melempari rumah Sar karena sudah geram dengan ulahnya yang dengan terang – terangan merusak hutan,” ketus Nuzul yang diamini warga lainnya.
Bahkan, lanjut Nuzul, Sar alias Olo kerap menantang Ilham untuk melaporkannya ke aparat penegak hukum seperti Polda Sumut, Polisi Kehutanan bahkan ke menteri.
Menanggapi hal itu, Ali menegaskan, aparat penegak hukum untuk segera menangkap antek – antek yang terlibat dalam perambahan hutan lindung. Karena, undang – undang juga melarang setiap orang melakukan perusakan kawasan hutan.
Pada Pasal 17 ayat 2 huruf (a) Undang – Undang Nomor 18 Tahun 2013 Tentang Pencegahan dan Pemberantasan Perusakan Hutan menegaskan, setiap orang dilarang membawa alat – alat perkebunan dan/atau alat – alat lainnya yang lazim atau patut diduga akan digunakan untuk melakukan kegiatan perkebunan.
“Ancamannya dipidana penjara paling singkat 3 tahun dan paling lama 10 tahun, serta dipidana denda paling sedikit Rp1,5 miliar dan paling banyak Rp5 miliar. Kalau yang melakukannya korporasi, ancamannya pidana penjara paling singkat 8 tahun dan paling lama 20 tahun. Serta pidana denda Rp20 miliar dan paling banyak Rp50 miliar,” tegas Ali.
Dengan amanat undang – undang, sambung Ali, sepatutnya juga aparat penegak hukum (APH) bergerak cepat menangkap para mafia perusak hutan. Bukan malah ‘main mata’ dengan mereka dan bukan pula mengkriminalisasi warga yang melindungi hutan.
Diinformasikan, Ilham dijemput secara paksa, karena merubuhkan bangunan di areal yang tercatat pada Peta Pengukuhan Kawasan Hutan Lindung sesuai dengan Keputusan Menteri Lingkungan Hidup dan Kehutan Republik Indonesia Nomor SK.6609/MenLHK-PKTL/KUH/PLA/2/10/2021.
Kasat Reskrim Polres Langkat AKP Dedi Mirza membenarkan terkait penangkapan Ilham beberapa waktu lalu. “Penangkapan itu, terkait adanya peristiwa 170 (tindakan dengan terang – terangan dan tenaga bersama menggunakan kekerasan tehadap orang atau barang) yang dilaporkan seseorang,” kata Dedi Mirza via telepon selulernya.
