Jakarta – Persis pada Kamis (18/4/2024) kemarin, Ilham Mahmudi dibawa paksa dari rumahnya di Dusun II, Desa Kwala Langkat, Kecamatan Tanjung Pura, Langkat. Penangkapan penjaga hutan lindung ini, imbas dari perjuangan ia dan rekan-rakannya memerangi mafia alih fungsi kawasan mangrove menjadi perkebunan sawit.
Penanagkapan pria kelahiran 18 September 1983 ini, atas dasar laporan Bahrum Jaya Pelawi terkait dugaan perusakan rumah. Di mana, rumah itu sendiri berdiri persis diatas areal yang tercatat pada Peta Pengukuhan Kawasan Hutan Lindung sesuai dengan Keputusan Menteri Lingkungan Hidup dan Kehutan Republik Indonesia Nomor SK.6609/MenLHK-PKTL/KUH/PLA/2/10/2021.
Hal ini pun menjadi sorotan publik di tanah air. Praktisi hukum yang merupakan Ketua Advokat Merdeka Pembela Rakyat (AMPERA) M Mualimin SH MH pun berang. Ia mendesak, agar polisi segera menangkap mafia perusak hutan mangrov di kawasan hutan lindung di desa tersebut.
“Makin lama pengusutan kasus perusakan hutan Mangrove, makin menunjukkan gagalnya APH melindungi alam Indonesia. Apa susahnya polisi mengungkap kasus yang terang benderang, begitu? Terhalang tembok apa? Ini ‘harga diri’ dan kehormatan negara diduga ‘diinjak-injak’ dengan pembiaran semacam ini,” kata Mualimin di Jakarta, Kamis (25/4/2024) pagi.
Dalam kasus ini, polisi harus memberikan surat panggilan. Ilham semestinya dimintai keterangan sebagai saksi sebelum ditangkap. Selain itu, saat penangkapan polisi semestinya didampingi perangkat desa atau kepala dusun. Keluarga Ilham juga semestinya diperlihatkan surat penangkapan.
“Setiap penangkapan (kecuali tangkap tangan) harus ada surat tugas pelaksanaan disertai menunjukkan surat penangkapan yang terdiri identitas Tersangka, menyebutkan alasan penangkapan, dan atas dasar persangkaan perbuatan apa seorang ditangkap. Ini semua diatur dalam Pasal 18 KUHAP dan semuanya demi kepastian hukum,” kata Direktur Lingkar Wajah Kemanusiaan (LAWAN) Institute ini.
Mualimin menambahkan, kalau ada dugaan polisi asal tangkap tanpa melalui prosedur administrasi yang benar menurut hukum, sejatinya itu lebih mirip seperti ‘penculikan’.
Idealnya, ketika menangkap seseorang, polisi juga harus menjelaskan yang ditangkap mau dibawa kemana dan ditahan dimana. Itu semua harus jelas dan terbuka. Menilai kasus ini, publik pun barasumsi, perusak rumah di hutan lindung cepat ditangkap. Sementara, mafia dan anteknya belum juga ditangkap.
“Mestinya polisi harus paham, bahwa kemarahan warga tersebut adalah bagian dari reaksi atas dugaan kegagalan APH karena tidak segera mencari pelaku perusakan hutan. Kalau sudah jelas mangrove atau hutan lindung dirusak, pasti kan ada tindak pidana,” kata Pengurus Majelis Nasional Korps Alumni Himpunan Mahasiswa Islam (MN KAHMI) itu.
Masalahnya, lanjut Mualimin, siapa yang semestinya bertanggung jawab, kenapa polisi diduga diam saja. Giliran warga marah dan mengobrak abrik bangunan milik perambah hutan, warga malah diduga dikriminalisasi. Polisi ini sebenarnya berpihak ke siapa. Apa keadilan sudah ‘buta’, mana hati nurani penegak hukum setempat.
“Atas nama perjuangan melindungi alam Indonesia dan kekayaan negara, Ilham Mahmudi harus dibebaskan! Polisi fokus saja mencari dan mengusut pelaku perusakan hutan mangrove. Jangan malah sumber dayanya digunakan untuk memenjarakan warga yang marah karena tidak mendapat keadilan. Dinilai peristiwa ini memalukan di negeri yang menjadikan Pancasila sebagai dasar negara,” tegasnya.
Dalam kasus Ilham ini, Mualimin berharap kepada Kapolres Langkat AKBP Faisal, Kapolda Sumut dan Kapolri untuk membebaskan Ilham. Petinggi polisi harus turun tangan. Bawahan yang diduga terlibat juga diperiksa dan ditindak.
“Ini semua sudah tidak benar, masa pejuang kelestarian lingkungan dipenjara. Sedangkan perambah hutan masih bebas keliaran. Dimana marwah Kepolisian sebagai pengayom masyarakat?” ketus Mualimin.
Masyarakat resah melihat antek mafia bernama Sarkawi alias Olo yang belum ditangkap. Padahal dia yang memfasilitasi dan memasukan alat berat ke hutan lindung dan atek-atek mafia lainnya. Prkatisi hukum ini juga meminta polisi memeriksa oknum kepala desa yang diduga ‘bersekongkol’ untuk merusak hutan lindung.
“Ya kalau kepala desa memberikan izin masuknya alat berat tanpa ada dasar hukum yang kuat, itu sama saja persekongkolan untuk merusak dan mengeksploitasi hutan mangrove. Dari situ saja sudah jelas dia ikut bertanggung jawab. Lalu apa yang ditunggu polisi? cepat dong bergerak, usut dan tegakkan hukum supaya tidak ada lagi yang berani melakukan alih fungsi hutan milik Bangsa Indonesia ini,” pungkasnya. (Ahmad)
