Medan – Warga Dusun II Desa Kwala Langkat, Kecamatan Tanjung Pura, Langkat dijemput paksa dari kediamannya, Kamis (18/4/2024) lalu. Ilham Mahmudi, yang menjaga hutan lindung di desanya, malah dikriminalisasi. Padahal, amanat UU Nomor 18 Tahun 2013 tentang Pencegahan dan Pembarantasan Perusakan Hutan, memberikan legalitas kepada masyarakat dalam upaya melindungi dan menjaga hutan dari kerusakan.
“Hal ini justru berbanding terbalik. Bukannya komplotan perambah hutan lindung yang ditangkap. Malah Ilham dan warga lainnya yang diduga dikriminalisasi,” kata Kordinator Solidaritas Masyarakat Anti Penyiksaan (SIKAP) Quadi Azam, Sabtu (27/4/2024) siang.
Dalam penyelidikan, lanjut Quadi, polisi wajib berpedoma pada peraturan perundang-undangan. Yakni harus memegang prinsip Profesionalitas, Transparan dan Akuntabilitas.
Apa yang dilakukan penyidik terhadap Ilham dan warga penjaga hutan di desa itu, semetinya dapat diukur dengan 3 prinsip teresbut. Penyidik harus mampu bertindak dalam penugasannya, dengan tetap menjunjung tinggi profesi dan kewenangan yang dimilki.
Kedua, penyidik harus menyampaikan informasi secara terbuka untuk dan agar tidak dikhawatirkan melakukan tugas diluar kewenangannya. Ketiga, penyidik harus dapat mempertanggungjawabkan tugasnya baik diminta maupun tidak diminta oleh para pihak.
“Kesemuanya prinsip diatas, merupakan bagian terpenting dalam menjaga Polri sebagai lembaga yang PRESISI sebagaimana mandat Kapolri. Artinya, jika penyidik dalam proses penangkapan dan penahanan diduga tidak sesuai dengan prinsip dan aturan yang ada, inilah yang disebut dengan kriminalisasi,” tegas Quadi.
Jika dibiarkan oleh pimpinan Satuan Tugas/Wilayah, maka berpotensi merusak tatanan dan marwah penegakan hukum. Polri telah mengatur secara komprehensif mekanisme dan hakikat penyidikan tindak pidana. Seperti yang diamanatkan dalam Perpol Nomor 6 tahun 2019.
Di mana dalam tugasnya, penyidik wajib mewujudkan supremasi hukum yang mencerminkan pada tujuan hukum. Yakni terkait hal kepastian hukum, rasa keadilan dan kemanfaatannya.
“Dalam penjemputan paksa Ilham, tentu antara laporan dan tuntutan mereka terkait dengan adanya perambahan atau perusakan ekosistem hutan lindung, juga harus ditindak sesuai dengan UU 18/2013 tentang Pencegahan dan Pembarantasan Perusakan Hutan,” tuturnya.
Secara tekstual, undang-undang 18/2013 memberikan legalitas atau dasar hukum, keberadaan masyarakat dikawasan hutan lindung dalam menjaga hutan. Sehingga dapat dimaknai, undang-undang ini berkontribusi dalam melindungi eksistensi mayarakat dalam upaya menjaga dan mencegah kerusakan hutan.
Masyarakat lokal semestinya menjadi bagian dari orang yang harus dibela negara. Intrumen internasional memandatkan, negara wajib menjaga keberadaan pembela Hak Asasi Manusia (HAM) / Human Rights Defenders (HRDs). Termasuk masyakarat yang memastikan perlindungan kawasan hutan yang dilindungi.
“Kapolri harus mengingatkan satuan wilayahnya untuk selaras dengan komitmen Presiden Jokowi dalam hal menjaga Kawasan hutan ini. Dalam upaya mitigasi perubahan iklim, negara ini sangat berkomitmen menjaga dan melestarikan hutan. Sehingga, jika ada indikasi atau dugaan seseorang/perusahaan yang diduga melakukan pengrusakan hutan, sama dengan merusak komitmen kepala negara dimata dunia,” tegas pemuda ramah ini.
Diinformasikan, Ilham Mahmudi, Kepala Dusun (Kadus) II Desa Kwala Langkat, Kecamatan Tanjung Pura, Langkat dijemput paksa belasan orang tak dikenal (OTK), Kamis (18/4/2024) Siang. Hal itu diduga, akibat gencarnya Ilham dan warga di sana yang menolak keras aktivitas alih fungsi kawasan hutan lindung di desa tersebut.
“Kami gak kenal siapa yang menjemput paksa rekan kami di rumahnya. Ilham ditarik paksa dan dimasukkan ke bagasi mobil. Tangannya diikat dengan tali. Sempat kami kejar juga, tapi mobilnya melaju sangat kencang,” kata Fikri dan warga lainnya, Sabtu (20/4/2024) siang.
Warga berharap, agara APH segera membebaskan rekan mereka yang dijemput secara paksa. Mereka juga meminta, agar mafia – mafia yang terlibat dalam perambahan kawasan Hutan Lindung di sana segera ditangkap.
Kasat Reskrim Polres Langkat AKP Dedi Mirza membenarkan terkait penangkapan Ilham beberapa waktu lalu. “Penangkapan itu, terkait adanya peristiwa 170 (tindakan dengan terang – terangan dan tenaga bersama menggunakan kekerasan tehadap orang atau barang) yang dilaporkan seseorang,” kata Dedi Mirza via telepon selulernya.
