MEDAN – Kasus dugaan korupsi yang terjadi di Sekolah Madrasah Aliyah Negeri (MAN) Binjai Provinsi Sumatera Utara terus menjadi sorotan publik.
Pasalnya, meski sudah berkali-kali digelar, proses penanganan kasus dugaan korupsi pada Pengelolaan Dana BOS dan Komite Sekolah MAN Binjai ini dianggap tidak menaati aturan yang sudah ditetapkan Kementerian Agama.
Seperti disampaikan Nasir SH, selaku kuasa hukum terdakwa. Ia sangat menyayangkan sikap jaksa, yang menurut pihaknya, sudah melangkahi perundang-undangan Kementerian Agama.
Dikatakan Nasir, proses jalannya pemeriksaan semestinya terlebih dahulu melihat aturan Kementerian Agama. Akan tetapi, pihak kejaksaan tidak mengikuti aturan tersebut.
“Yang jelas dari kejaksaan melangkahi aturan dan perundang-undangan Kementerian Agama yang diatur di tahun 2016 tentang pemeriksaan,” kata Nasir SH, usai sidang lanjutan di Pengadilan Negeri (PN) Kelas I A Khusus Medan, Jum’at (12/1/2024).
Ia menjelaskan, di dalam Peraturan Kementerian Agama disebutkan, pihak kejaksaan terlebih dahulu meminta keterangan dari pihak BPK dan Irjen Kementerian, sebelum mengambil kesimpulan sebagaimana yang dituduhkan kepada terdakwa.
“Namun, pihak kejaksaan tidak meminta keterangan dari pihak BPK dan Irjen Kementerian. Karena merekalah yang mengawasi benar atau tidaknya dana bos itu yang digunakan. Jadi, saat ini pihak kejaksaan tidak memakai itu,” jelasnya.
Selain itu, ia juga membeberkan, pada tahun 2021 pihak MAN Binjai sudah melakukan kewajiban pengembalian uang kepada pihak kementerian. Hal itu dikarenakan kelebihan anggaran, bukan masuk dalam ketegori Tuntutan Ganti Rugi (TGR).
Hal ini, lanjut Nasir, menimbulkan pertanyaan terkait besarnya kerugian negara seperti yang disebutkan pihak kejaksaan.
“Apalagi pihak Kejaksaan Negeri Binjai menjelaskan adanya kerugian negara. Yang jadi kerugian negara itu dimana? Sementara uang sudah dikembalikan, dan bukti-bukti pengembalian nya ada. Jadi siapa yang dirugikan? Lantas, pihak Kejaksaan melaporkan adanya kerugian negara, sementara itu sudah dikembalikan,” bebernya.
Sebab itu, kata Nasir, sangkaan jaksa Kejari Binjai terhadap terdakwa dianggap tidak memiliki kekuatan hukum tetap. Karena kejaksaan tidak mempunyai cukup bukti atas tuduhan yang dimaksud.
“Kita berharap hakim PN Medan dapat mengambil sikap yang bijaksana, sehingga terdakwa dapat dibebaskan,” ujarnya.
PEMERIKSAAN SAKSI
Sidang kasus dugaan Tipikor MAN Binjai masih dalam tahapan sidang pemeriksaan saksi yang dipimpin Majelis Hakim M Nazir SH MH dan Mohammad Yusafrihardi Girsang SH MH, serta Sontian Siahaan SH CN.
Sebelumnya kepada wartawan baru-baru ini, Kajari Binjai melalui Kasi Intel Andre Wanda Ginting SH MH mengatakan, sidang tersebut sudah ke-4 kalinya digelar, dan masih seputar pemeriksaan saksi.
Andre juga meyebutkan, sidang lanjutan atas perkara yang dimaksud akan kembali digelar pada Senin (15/1/2024) mendatang dengan agenda yang sama, terkait pemeriksaan saksi.
DANA BOS
Seperti diketahui, kasus dugaan tipikor pengelolaan dana BOS dan komite sekolah yang berkisar satu miliiar lebih ini disebut-sebut menyeret Evi Zulinda Purba SPd MM selaku Kepala Sekolah MAN Kota Binjai dan Nana Farida SPdi sebagai Bendahara MAN Kota Binjai.
Kemudian, Teddy Rahadian SHI selaku PPSPM, terdakwa Aqlil Sani SE selaku penyedia dari CV Setia Abadi, terdakwa Nurul Khair SE, selaku sales PT Grafindo. Lalu terdakwa Suhardi Amri selaku penyedia dari CV Azzam. (Red)
