Stabat – Belasan korban dalam perkara Tindak Pidana Perdagangan Orang (TPPO) dengan terdakwa Mantan Bupati Langkat Terbit Rencana Peranginangin (TRP) menolak pembayaran ganti rugi (Restitusi). Alasannya, para korban dalam perkara tersebut, merasakan manfaat selama dibina di panti rehab dekat kediaman TRP.
Hal ini disampaikan Anggun Rizal, Penasihat Hukum TRP usai penundaan pembacaan tuntutan JPU dalam persidangan di PN Stabat, Selasa (14/5/2024) sore. “Dari beberapa orang yang menerima restitusi berdasarkan dakwaan, hampir keseluruhan telah mencabut surat pernyataannya. Total restitusinya sekira Rp2,6 Miliar,” tegas Anggun.
Artinya, kata Anggun, mereka tidak meminta restitusi dalam perkara tersebut. Bukti surat pernyataan itu, nantinya akan dilampirkan dalam nota pembelaan (Pledoi) terhadap TRP di persidangan mendatang.
Pastinya, para korban yang mencabut pernyataannya itu merasa mendapatkan manfaat selama menjalani pembinaan di panti dekat rumah TRP. Mereka juga sembuh secara total dari ketergatungannya dari mengonsumsi narkotika.
Selain itu, selama menjalai pembinaan, para penghuni panti itu tak dipungut biaya sama sekali. Bahkan, mereka memiliki keterampilan saat keluar dari tempat tersebut.
“Yang dulunya tidak bisa nyupir, sekarang dah mahir. Pendapat mereka, kerangkeng itu tidak seseram seperti dalam pemberitaan sebelumnya. Mereka merasa nyaman, senang, bahkan mendapat keterampilan. Makanya mereka mencabut restitusi tersebut,” tutur Anggun.
Sebelumnya, untuk ketiga kalinya, sidang perkara Tindak Pidana Perdagangan Orang (TPPO) dengan tersangka Mantan Bupati Langkat Terbit Rencana Peranginangin (TRP) kembali ditunda, Selasa (14/5/2024). Alasannya, jaksa penuntut umum (JPU) belum menyelesaikan nota tuntutannya.
Menanggapi hal itu, majelis hakim yang diketuai Andriyansyah SH MH memberi terguran keras kepada JPU. “Sidang kita tunda hingga 21 Mei mendatang. Jika nanti JPU belum juga menyelesaikan tuntutannya, kami akan mengirim surat ke Kejaksaan Agung,” tegas Andriansyah sembari menutup persidangan.
Sidang yang digelar di ruang Prof Dr Kusumah Admadja itu, dihadiri kerabat dan anak serta Tiorita Br Surbakti yang merupakan istri TRP. Ratusan kader Pemuda Pancasila juga memadati areal PN Stabat hingga ke ruang sidang, untuk memberikan dukungan moril kepada TRP.
Usai persidangan, Tiorita menyampaikan harapannya agar proses hukum terhadap suaminya berjalan dengan baik dan seadil-adilnya. “Semoga sidang ini bisa segera diselesaikan. Karena, kami keluarga sangat menantikan kepulangan bapak Terbit Rencanaperanginangin,” tutur Bacalaon Bupati Langkat ini.
Kemudian, Tiorita mengharapkan agar jaksa bijaksana dalam membuat tuntutannya. Karena, sepanjang dalam persidangan tidak pernah nama TRP disebut-sebut keterlibatannya. Tiorita juga sangat berharap agar keadailan dapat ditegakkan dengan sabaik-baiknya.
Anggun Rizal, Penasihat Hukum TRP menerangkan, sudah tiga kali sidang tuntutan terhadap kliennya itu ditunda. “Kalau kami fikir, alasannya tidak jelas, karena belum siap. Kami menganggap, jaksa tidak siap membuat tuntutan berdasarkan dakwaan yang mereka buat sendiri,” kata Anggun.
Timnya berharap dan memohon kepada majelis hakim, agar ada ketegasan ketika minggu depan JPU belum juga menyiapkan tuntutannya. Bahkan hakim menegaskan, akan menyurati Kejakaksaan Agung jika JPU belum menyelesaikan tuntutannya pada persidangan mendatang.
Diketahui, perbuatan terdakwa Terbit Rencana Peranginangin sebagaimana diatur dan diancam pidana dalam Pasal 2 ayat (2) jo Pasal 7 ayat (2) jo Pasal 10 Undang-undang RI Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang.
Adapun barang bukti dalam perkara ini yaitu, tanah dan bangunan sel/kereng/kerangkeng yang dipergunakan untuk mengurung/menampung para korban/anak kerangkeng berikut dokumen kepemilikan tanah dan bangunan tersebut. (Ahmad)
